Setting the scene

General update What is interesting of late is the regulator reactions to the government on their progress on ‘growth’ initiatives that were communicated from last January 2025. There seem to be reminders that ‘we have done our bit’, but what has happened with the government fulfilling their end of the bargain. We covered the strong message from ECB around regulating the enforcement sector. We witnessed it with the FCA responding on their progress over the last 12 months, notably where primary legislation is required to move to the next stage. Whilst a number of pieces of legislation are referenced in the “Dear Meg” letter from the FCA to Dame Meg Hillier at the House of Commons from 21 January 2026, I have highlighted BNPL legislation.
